WARRANTY INFORMATION:

We guarantee our products from manufacture defects within the first 30 days from the date you receive your item. Warranty is on a parts exchange basis only. www.mxmotorsports.us will service your vehicle under warranty at no additional costs. However, it is buyer's responsibility to ship or bring in your vehicle to our facility for warranty service(s). Any outside repair labor charges, down time, towing or shipping charges are not covered under warranty. Warranty period starts from the date you receive your vehicle. Warranty covers factory defects and defaults only. We do not cover misuse or broken parts caused by the user or by any other event. However, it is buyer's responsibility to ship or bring in their vehicle to our facility for warranty service(s).

To file a warranty claim, please log on to our website: www.mxmotorsports.us  and from the Customer Service drop down menu select Warranty Claim Form. Defective warranty part(s) are required to be returned to exchange for new replacement part(s). New replacement part(s) under warranty will be shipped to you at no additional costs. Returning your defective part(s) will ensure we send you the correct part(s) and assist us in monitoring and correcting potential manufacture defects. Replacement parts are shipped without charge, but it is customer's responsibility to physically install the replacement parts or bring your vehicle in for service.

Changes, Errors & Inaccuracies:
MxMotortoys reserves the right to update or modify these Terms & Conditions at any time without prior notice. Improvements to products may result in unannounced small changes to specifications and external appearance. We strive to list and advertise all text and product information as accurate as possible. However, unforeseen typographical errors, picture errors and inaccurate information on this website may occur. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice, including order that have already been submitted. If such errors occur, we apologize for any inconvenience.


Assembly:
All vehicles require some simple assembly. Each vehicle is unique and will have different assembly requirements. Common assemblies include: mounting wheels (nuts and bolts, tires already mounted on wheel), handlebar (nuts and bolts), electrical connection (simple plug in), battery hook up (nuts and screws) and mirrors (screws). Mechanical assemblies such as: motors or carburetors are not required. Our vehicle can be assembled within 30 minutes to 3 hours depending on the vehicle you purchase. For your safety and the safety of  your family, any necessary assembly or maintenance should be performed by a certified technician.

THIS LIMITED WARRANTY COVERS THE FOLLOWING PARTS ONLY:
Engine long block assembly, including all internal lubricated parts, i.e. Rings, pistons, pins, crankshaft and, main bearings, the connecting rods, and rod bearings, camshaft bearings, timing chain gears, rocker arms, valve springs, valve guides, valve seats, valve push rods, valve lifters, and oil pump. Additionally, the engine head(s), engine block and cylinder barrels will be covered if they are solely as a result of the mechanical failure of one or more of the internal lubricated components specified above. The Cooling system must be in good working order including cooling fans. Accessory items, including but not limited to electrical components of all types (distributor, alternator and all sensors and electrical control devices), fuel systems, gaskets, seals, filters, mounts linkage and fluids are not covered by this agreement.

TRANSFER CASE: All internal lubricated parts contained within the transfer case. The transfer case itself will be covered if damage solely as a result of the mechanical failure of one or more of the internal lubricated components contained within the transfer case. Accessory items, including but not limited to, U-joints, electrical components, linkage, seals, gaskets, mounts or fluids are not covered by this Agreement.

DIFFERENTIAL: All internal lubricated parts contained within the drive axle housing case. The drive axle housing itself if damaged solely as a result of the mechanical failure of one or more or the internal lubricated components contained the drive axle housing. Accessory items, including but not limited to, backing plates, all brake system components, cables, controls, linkage, vents, pumps, U-joints, electrical controls, mounts, seals, gaskets, and fluids are not covered by this Agreement.

TRANSMISSION (Automatic or Standard): All internal lubricated parts contained within the transmission case. The transmission case itself if damaged solely as a result of mechanical failure of one or more of the internal lubricated components contained within the transmission case. The Complete hydraulic system must be flushed including integral transfer case, oil cooler, lines, and new filter(s) installed Accessory items, including but not limited to, modulators, governors, electrical controls, linkage, mounts, seals, gaskets, and fluids are not covered by this agreement.


COVERAGE AND LIMITATIONS: You may want to have professional mechanic (any small engine repair shop, motorcycle shop, or local auto repair shop) or an authorized  Dealer assemble your new motorized vehicle and do the prep work to assure your is in good working condition. You will need to provide proof of this when filing a warranty claim, so keep your receipts. Subject to the limitations stated in this agreement, MxMotorsports agrees (at its sole discretion and election) to replace a covered component if the covered component fails as a result of one or more of the internal lubricated parts within the component stated warranty period from the date of purchase, while the component is being used under the conditions and in the manner specified by its original manufacturer. Please note that most of our scooters come assembled and only require very little assembly so you may not need to have  a mechanic .

The following items are not covered under any circumstance.

Tires, rims, body panels, fuses, forks, shocks, gaskets, light bulbs, seats, CV Boots, oil filter, air filter, fuel filter, filters, clutch wear parts, cables, drive belt, chain, spark plug, any part made from rubber, belts, brake linings and/or pads, batteries, sprockets, external springs, clips, nuts, bolts, fasteners, frame.

THIS AGREEMENT AND LIMITED WARRANTY IS VOID IF ANY OF THE FOLLOWING IS TRUE:
• THE CUSTOMER DOES NOT USE A PROFESSIONAL MECHANIC (SMALL ENGINE REPAIR SHOP, MOTORCYCLE SHOP, OR AUTO REPAIR SHOP) OR AN AUTHORIZED  DEALER TO ASSEMBLE AND PREP THE PRODUCT PRIOR TO OPERATION. Proof of this is required for warranty claims.
• THE DAMAGE TO THE COMPONENT IS CAUSED BY AN ACCIDENT.
• THE CUSTOMER FAILS TO FOLLOW THE MINIMUM MAINTENANCE AND BREAK-IN REQUIREMENTS SUGGESTED BY THE MANUFACTURER. AND FAILS TO PROVIDE PROPER SERVICE DOCUMENTS.
• THE DAMAGE TO THE PRODUCT IS CAUSED DURING SHIPPING.
• PRODUCT IS USED IN A MANNER WHICH IT WAS NOT DESIGNED FOR.
• THE PRODUCT IS MODIFIED IN ANYWAY.
• THE PRODUCT IS USED IN RENTAL BUSINESS.

TOWING CHARGES: All towing and/or shipping charges incurred are the responsibility of the customer.

REPAIRED COMPONENTS: If the components are repaired under the terms of this agreement, they will be repaired or replaced with component parts of like kind and quality.

LABOR TO REPAIR OR REPLACE PARTS: MxMotorsports does not pay or reimburse any labor cost under any circumstances.

S&H Charges and WHO pays:
IN WARRANTY: If your product is still under warranty you may return any part for exchange, at your expense, to our one of our Distribution center. We will pay return shipping to you unless it is determined your part was abused or damaged other than manufacturers defect. Your dealer may handle the parts exchange for you at no expense to you however the option to do so is that of the dealers and we have no control of a dealers in house parts exchange policies.

Out of warranty: Customer is to pay for parts, S&H both ways and all labor charges.

In all cases you must send us the part that needs to be replaced. Failure to do so may result in your getting the wrong part. We are not responsible for wrong parts sent if we do not have your part to exchange and verify correct part numbers.

SHIPPING POLICY: The following is our shipping policy.
• All shipping related fees are prepaid in full. Unless the customer is using Freight collect or has arranged his/her own freight.
MxMotorsports can not guarantee delivery schedule.
MxMotorsports is not responsible for shipping delays.
MxMotorsports is not responsible for damages occurred during shipping.You can file Claim with Shipping company please inspect your product!
MxMotorsports is not responsible for any extra cost incurred by the customer after the part has been shipped.
MxMotorsports is not responsible for return shipping costs and these costs must be included with the initial part order. If shipping funds are not included the part will not be shipped.
MxMotorsports is not responsible for any cancellation incurred cost. All incurred cost due to cancellation must be paid in full and is not refundable. (Example: If product or part has left the warehouse and the order is canceled. The shipping company will charge freight whenever the product leaves our warehouse.

At MxMotorsports we are committed to providing you with excellent after-sale service by offering you a limited manufacturer’s parts warranty.  The warranty for your purchase begins on the date of delivery of your unit.

Under no circumstances will MxMotorsports pay or reimburse assembly charges or any labor cost associated with warranty replacement.

If you want to ship your Product to us, we will perform the warranty labor for you however they maybe a labor charge upon inspection or there will be no charge and you will be responsible for all shipping costs associated with returning the unit to us and having the unit shipped back to you once the replacement is complete. We have trained service technician on hand Monday through Friday, 9 am to 6 pm CST.

RETURNED PARTS:

Defective warranty part(s) are required to be "returned to exchange" for new replacement part(s). New replacement part(s) under warranty will be shipped to buyer at no additional costs.  Returning your defective part(s) will ensure we send you the correct part(s) and assist us in monitoring and correcting potential manufacture defects. Please provide a tracking number when sending defective parts back!

For your safety and the safety of your family, any necessary assembly or maintenance must be performed by a certified technician in order for warranty to be valid. There may be unforeseen issues that require the expertise and knowledge of a trained professional. These issues include, but not limited to: electrical connections that have become disconnected in shipping, vacuum or fuel hose(s) dislodged in shipping and Loose nuts and bolts in need of tightening. While these issues are normally very simple to correct, most being a simple re-connection, they can be a nuisance and very difficult to troubleshoot without the proper knowledge.

Our first concern is your safety and satisfaction. These vehicles will be driven at high speeds and by children in some cases. These concerns are better preserved by having your vehicle properly assembled and inspected prior to use.
